Homeowner Shoots, Kills Teen Burglary Suspect

MIAMI (CBSMiami) – Relatives of a 17-year-old are angry the teenager was shot and killed by a homeowner who police say was protecting her property.

The sister of the teen who died identified him as Trevon Johnson. She said he was a student at D. A. Dorsey Technical College.

“I don’t care if she have her gun license or any of that. That is way beyond the law… way beyond,” said Johnson’s cousin Nautika Harris. “He was not supposed to die like this. He had a future ahead of him. Trevon had goals… he was a funny guy, very big on education, loved learning.”

On Thursday, police say Johnson burglarized a home south of 79th Street near I-95 — just blocks away from where he lives.

The 54-year-old woman told police her surveillance system alerted her to the break-in of her home. She said she rushed home and found the teen climbing out of a window.

“She observed a subject leaving the home through the rear,” said police Det. Dan Ferrin.

Miami-Dade police said there was a confrontation and shots were fired. Police said they were on scene seconds after the shooting and gave CPR to the teen. Johnson was rushed to the hospital where he was pronounced dead.

“What’s wrong with her,” asked Johnson’s sister Nisha Johnson. “She did not have to shoot him.”

“It’s no reason she should have waited until I think he walked out the yard to try to shoot him,” said Harris. “If she called the police already why would she shoot him?”

Relatives said they don’t believe Johnson stole anything from the home but detectives would not confirm that.

“You have to look at it from every child’s point of view that was raised in the hood,” said Harris. “You have to understand… how he gonna get his money to have clothes to go to school? You have to look at it from his point-of-view.”

Police said the homeowner is cooperating with detectives and was taken to a police station for questioning.

“She’s a person that is a little distraught because this is her home that someone obviously was in,” Ferrin said.

Investigators said they’re still trying to sort all of this out and want the public to remember that, if possible, it’s best not to take these types of situations into your own hands.

“If there’s any type of situation that happens or they believe there’s a burglary at the home or any type of confrontation, dial 911. Have the police make that confrontation,” Ferrin said. “That’s what we’re here for.”

The case has been handed over to state attorney’s office but, so far, no charges have been filed against her.

My goodness the cops were called she got home before they did caught the kid crawling out the window.... I would have shot his azz too..

Since I was not there and no video to watch who knows if she could have just went to wound him instead or not.. When you are in that situation and you have took shooting lessons you are taught to shoot to kill not to ohh let me see if I shoot them in the leg or the air will they stop and give themselves up?? Most likely heck no they are going to come after you and take you down...

This is why I finally changed my mine on getting protection due to living alone... Someone breaks into my house if I'm in there they are going down.. Never wanted or cared to have a gun.. But ya can bet that has changed with all that happens in this world now..

I agree with Sparky
Don't blame the woman for protecting herself and her property.
She didn't know how dangerous the situation was or even if he was dangerous.

Look at the child point of view????
Get a job and pay for your own stuff not steal other's.

Say what??? spock

I can't imagine any parent telling their kid to go steal their school lunch money from a neighbor. Also, if a kid comes home with a pair of brand new Nikes, that should ring alarm bells with his parent(s).

There's something terribly wrong in da "Hoods"

"He had a future ahead of him"...um ni he didn't.

He was breaking into peoples homes.... his future would have been behind bars.

when he broke into the woman's home he chose a different future. ..either jail or dead....

you chose your actions, and the wrong ones have consequences, sometimes permanent ones

I dont know what happened

IF he robbed her , he committed a crime,, robbery doesnt carry a death sentence

If he was climbing OUT of her home before she got inside her home, she was wrong to shoot him,,,imho

if she was in the house when it happened, where fear for whether her life was in danger when he climbed IN,, that would be different

but if she had already been alarmed while she was someplace safe, and called the police while she was someplace safe but RUSHED HOME ARMED ANYWAY,,,and
found him already leaving,,,and if it was clear he was leaving,, and did not in any way approach or threaten her ,

SHOOTING him was wrong and she should be charged imho

the alarm and the police aren't there to signal your chance at target practice,, human life is irreplacable

but Florida is crazy that way and will probably support her actions,,,

There is a fix to this....make robbery of a persons home carry a death sentence...then either way same result.

If he climbed out the window, he probably had something of hers, maybe jewelry or money but her property. Some kind of altercation took place and he dead in da hood now.

A persons home should be the one place on this planet they should feel completely safe, no question.

I would have shot him myself, with my bare hands!!!!

Where I am from you have a right to protect yourself. That is the test for if charges are filed. Not really enough information to apply that test to this. I have read that some places extend that to your property. Of course this would be in regards to criminal charges. Civil charges have different rules. Looks like folks are getting in line for the lawsuits.

It was her house so she had a right to be there. Were this to have happened in my home town the focus would be on the confrontation and if a reasonable person would feel in danger of great harm or death.

Had she been home at the time of the break in, the laws here say that alone is enough to shoot.

I have to agree with msharmony in that the info posted dose not have enough info for us to know what happened or what is legally permitted.

I hold a Conceal Carry License in my home state. But different states have different laws. So folks from different states will see this different from a legal point.

This is my sentiment exactly. I would have shot him..

If he had such a bright future what was he doing robbing... And where is he supposed to get his clothes...
Get a job like the rest of us... Period.

And as far as home invasion not a death sentence maybe we should make it.

In Alaska, we don't have to have a concealed Weapon's permit it is legal and expected we "all" carry a gun... We do have signs up at bars, lodges, diners etc... No weapons allowed and they mean it. leave them in your car...

You come into my home robbing it and I beat the troopers there I will shoot you... No one knows what the "confrontation" was...

Hood mentality be damned time to stand up and say enough is enough...

I love the mind set of the family, he lives in the hood and how else is he gonna get his money. It's this type of attitude and outlook right here that is getting African American's killed. They are being told it's ok or feel they are entitled and when they get caught, they riot.

Yeah, but your also taught to pull your gun and shoot if your in a live threatening situation and there is no other option. I don't know the details, but it sounds like she shot him to prevent him from leaving the property, and in my opinion that isn't ok.......

If she would have been inside the house when the break in happened, that would be another story.

You break into someone home... you already rolled the dice.

Doesn't matter if you were coming in the window or going out the window.

The homeowner does not have to try to figure that out. The homeowner has the right to shot.

You don't break in.. you don't get shot.

Pretty simple stuff

Yo know, a few years ago I would have agreed with you but dealing with theft on a daily basis and knowing the laws we need to know more about this situation to know if it was a good shoot or not.

The laws in almost every state regarding theft, burglary and strong armed robbery states you can use equal-reasonable force to detain the suspect to hold for law enforcement.

If I have someone coming into the store and taking items and leaving, I cant just pull a gun and shoot at him\her I can only match force with force........
