Massachusetts State Police and the National Guard sent a helicopter, several vehicles and a handful of troopers to an elderly woman's house to chop down one cannabis plant and haul it away in a pickup truck.

Margaret Holcomb, 81, grew a single marijuana plant in her garden, which she used to ease her glaucoma and arthritis ailments, The Washington Post reported.

She hadn't attempted to obtain a medical marijuana card due to the difficulty of getting a doctor to sign off on it, she told The Daily Hampshire Gazette. She said traveling to the dispensary in the next town and paying for marijuana grown by someone else would be too costly.

The behavior of the police was questionable in other ways, Holcomb's son, Tim, told the Gazette. He said he was told that as long as he did not demand that a warrant be provided to enter the property or otherwise escalate the situation, authorities would file no criminal charges.


Comment: He was told not to demand a warrant, because the officers likely didn't have one and they were trying to avoid the legal ramifications of their unlawful behavior.


He believes their actions constituted an "unlawful surveillance and illegal search and seizure."

State police spokesman David Procopio told the Gazette that authorities also seized 43 plants from other properties during the raid. The largest of these seizures involved 20 plants, while several properties netted only two plants each. None of the property owners were charged, Procopio said.

The Drug Enforcement Agency (DEA) gave Massachusetts $60,000 for marijuana eradication efforts, Procopio said, citing federal documents.


Comment: They have to spend the money somehow if they want to continue to receive the funding. Even if that means creating or hyping non-existent threats, or bringing the hammer down on little old ladies that are just trying to survive.


The program's stated goal is to "halt the spread of cannabis cultivation in the United States." But with an increasing number of states legalizing recreational marijuana use in recent years, some lawmakers are questioning whether an $18 million federal program to pull pot plants makes sense.

Last year in Utah, a member of a cannabis eradication team testified that a medical marijuana law could lead to an "epidemic of stoned rabbits" and other animals. The DEA officer's remark prompted online ridicule.

Under Massachusetts law patients may grow as many marijuana plants as necessary to meet their medical needs, provided they have a medical marijuana license.

In 2014, marijuana eradicators in Georgia raided a retiree's garden after mistaking okra for marijuana.

Holcomb's case is providing fresh ammunition for critics of strict anti-marijuana enforcement, particularly given voters in Arizona,California, Maine, Massachusetts and Nevada will consider whether to legalize the plant for recreational use on November 8.

I watched that show "cops" last night, I never watch it.

On this episode, the black kid was stopped, then handcuffed while the cop checked his ID out in his cruiser. Well, the kid tosses a tiny bag in the bush while he's handcuffed.

The cop came out of his car and told the kid he went from misdemeanor pot possession to Felony tampering with evidence.

Ruining the kids life right there... WTF is wrong with law enforcement??? Idiots!

A lot of these Police departments go way overboard. A few years ago many were able to get used Military gear and weapons Surplus stuff. My relatively small town( in Jersey) got 2 grenade launchers???

So don't speed in Middletown N.J... O.K. ;)

The then formed what they call "TNT" team. ( Tactical Narcotics Team)

They dress in black jump suits with black face coverings ( they look like Ninja's).. but everyone know their identity.. one is the cop around the corner from me. Everyone in town ( good and bad) know who they are.

As opposed to surrounding a house and knocking on the door. they break it down... (windows to) and storm trooper their way in. In full battle gear.

In reality , they look and act like idiots all dress up like that. Not to mention the total waste of taxpayer money on excessive personnel and equipment.

I like cops guys... but excessive.. is excessive.




Exactly, they're no longer part of the community... they now some gungho squad who bust into homes with helicopters, armoured carriers all at taxpayers expense

It's not ok to grow 1 plant for personal use and (not ready for consumption) The judge would have a hard time convicting Grandma dynamite on this.

Ummm...15! 15 cops to chop down one MJ plant.
1 cop to call a private contractor that'll bill the city 100k to come in and say it was harder than expected so need 150K to do it, 2 to hold a gun on it to make sure it isn't armed, 2 to trash the place looking for more evidence and raid the fridge for something to eat, and 10 to look for someone else to shoot?

I wouldn't doubt that.
And it's not all that unusual.
It's perfectly legal for police to lie about pretty much anything.
They just can't do certain types of blackmail.
Like "don't ask for a lawyer or I'll blow your head off!" or "sign the confession or I'll blow your head off, and your mothers too!"

Unfortunately too many people say things like "shouldn't you have a warrant? Don't you need a warrant? Should I get a lawyer?"
When you ask a cop a question you are simply asking to be lied to.

it actually started under Reagan/Bush I, was expanded under Clinton, expanded further under Bush II, and then reduced under Obama.

Since Clinton was elected because he WASN'T a classic liberal, you have to be one of those people who insist that all Democrats are liberals as well, to blame liberalism. And you have to ignore that another Democrat cut the program back again, because of the growing abuses.

I can see I am in the minority on this topic. I feel some of you really need to walk a mile in the LEO shoes. They do NOT know what they may get into when they go in. So yes they sometimes over do it with manpower to try and keep all safe until they do know.

As for the legalisation on Pot. Many of you in this thread show the very reason why many of us in Colorado are seeking to reverse the decision of Recreational Pot. You spout all this good but refuse to see the bad that YES does go along with it. We gave you a chance and instead of using in a polite manner you have taken advantage and forced your views upon us.
