Lawyer hints at 'fraud' in baby's birth certificate

NASSAU, Bahamas (CNN) -- A lawyer representing one of the men claiming
to be the father of Anna Nicole Smith's infant daughter alleged Monday
that there is "fraud" in the child's birth certificate.

Larry Birkhead and his attorney Debra Opri were attending a hearing over
custody of the child in Nassau, Bahamas. Afterward, Opri said there is a
"big hole" in the certificate.

She refused to comment further, as she and her client smiled and gave
thumbs up to reporters swarming them.

Smith's boyfriend at the time of her death, Howard K. Stern, has said he
is the baby's father.

Attorney Wayne Munroe attended the hearing Monday in place of Stern.

Virgie Arthur, Smith's estranged mother who also wants custody, was
there as well.

After the hearing, she was bombarded by reporters on the way to her
waiting limousine.

A hearing in the matter was scheduled for March 16.

Who gets the house?
Later in the day, Smith's estate faced another battle -- this one over a
house where Smith lived.

A South Carolina developer says he owns the home and Smith never paid
him back for it, though she had said it was a gift.

Stern has been living in the home with Dannielynn. There are concerns
over what would happen to the baby if Stern is evicted.

The judge hearing the case allowed Stern and Dannielynn to stay in the
house pending a March 14 hearing on all the issues.

Body battle royale
Meanwhile, back in South Florida, Arthur's petition was granted to block
an earlier ruling giving custody of Smith's remains to an attorney
representing her infant, Miami-based Richard Milstein.

Florida's 4th District Court of Appeals gave Milstein and attorneys for
Stern until 2 p.m. Tuesday to file responses.

Milstein had opted to have Smith buried in the Bahamas next to her son,
Daniel.

Daniel died a few days after Dannielynn's birth.

Arthur wants Smith buried with other family members in Texas.

Arthur's attorneys argued a strict reading of Florida law gives her
custody over Smith's remains. Her lawyers say that when there is no
spouse and no child at least 18 years old, custody over the remains goes
to the next of kin, which in this case is the mother.

Judge Larry Seidlin, in a tearful televised ruling last week, awarded
custody to Milstein.

Seidlin found precedent suggesting that if a deceased person had
expressed a desire about how to handle his or her remains, that should
be followed. He found Smith had expressed a desire to be buried
alongside her son in the Bahamas and had bought a burial plot there.

Seidlin ruled that Dannielynn is Smith's next of kin.

Arthur's attorneys asked Seidlin to stay his original order, but he
denied the request Monday morning. The judge said he is concerned about
the deterioration of Smith's body. She died February 8.

Amid all this, yet another piece of news introduced new questions into
the story.

U.S. law enforcement officials had an appointment with Dr. Hubert
Minnis, Smith's obstetrician-gynecologist in the Bahamas, to ask about
any drugs Smith may have been taking that he was not prescribing, a
Bahamian official close to the case told CNN.

DNA baby.........that's all it takes to find the truth and I am sure it

appeal again after shes buried..how horrible doing that to your
daughter..christ, let her rest in peace..thats what i heard, shes going
