Fruits and vegetables can't be patented, no organic natural material can. Well ... once again you have proven that you know absolutely nothing about the subject. http://www.legalzoom.com/intellectual-property-rights/patents/plant-patents-how-has A history of plant patents. http://www.monsanto.com/food-inc/pages/seeds-patent-history.aspx And .... the present and future of farming ... "Finally, the agrochemical industry claims that its seed innovation has provided farmers more choices. Yet the market concentration of 10 agrochemical companies owning about two-thirds of global commercial seed for major crops has narrowed the choice of seeds for farmers and resulted in higher seed prices. Over an 11-year period, the cost per acre of planting soybeans has risen a dramatic 325%." http://articles.latimes.com/2013/feb/19/opinion/la-oe-kimbrell-monsanto-supreme-court-seed-20130219 I would suggest you perhaps learn to read and comprehend what you are posting before making idiotic claims. Your comprehension on this matter seems to be on the same level as the global warming issue. The subject of plant patents may sound like a boring one, but it affects every single one of us and the food we eat. The resurgence of interest in plant patents stems from the fact that "new and improved," genetically modified crops are eligible for patents, and these plants' patents have a significant impact on farming practices and the future of traditional, independent farmers across the country. You cannot patent anything in nature, it belongs to the universe. Only man made items can be patented, how about we order up some of those patented plants for you. Maybe one of those idiots over at NASA will bring them over for ya in between rigging global temperature charts and signing off on the IPCC co2 is dangerous reports. So instead of admitting you were wrong, you just spout garbage. The evil of Monsanto at work. http://www.divinecaroline.com/life-etc/home-food/sprouting-evil-how-monsanto-endangers-heirlooms Admitting I was wrong, no I just provided proof that you are totally in error just as you were in the man-made climate issue. What part of the quoted section from your source do you have a problem understanding. But how about we just take it to the elementary stage and see if that helps: Requirements for Patentability The five primary requirements for patentability are: (1) patentable subject matter, (2) utility, (3) novelty, (4) nonobviousness, and (5) enablement. Patentable Subject Matter The patentable subject matter requirement addresses the issue of which types of inventions will be considered for patent protection. Under 35 U.S.C. 101, the categories for patentable subject matter are broadly defined as any process, machine, manufacture, or composition of matter, or improvement thereof. In Diamond v. Chakrabarty, the Supreme Court found that Congress intended patentable subject matter to "include anything under the sun that is made by man." See Diamond v. Chakrabarty, 447 U.S. 303 (1980). However, the Court also stated that this broad definition has limits and does not embrace every discovery. According to the Court, the laws of nature, physical phenomena, and abstract ideas are not patentable. The relevant distinction between patentable and unpatentable subject matter is between products of nature, living or not, and human-made inventions. I know this may be a stretch quoting legal definitions, but look in the yellow pages under "Lawyers and Shysters" and maybe they can help. Or maybe NASA can buy someone to declare it your way. |

PLANT BREEDERS RIGHTS Under this set of rules and guidelines (laws) Companies that develope a new variety of a crop, have total legal control over seed produced. This means a farmer must buy seed from that company, and cannot sell seed from his crop to another producer. If they catch you growing a crop, and haven't bought seed from them, you will end up in court, and you will pay dearly. A farmer can keep seed from his own crop, and use it for planting. But they (agro corporations) would like to stop that also. This would be done by introducing a 'Terminator' gene into the plant. This gene causes the seed from the plant to be sterile...therefore, it will not germinate and produce a plant. This is just a small part of a very big picture. A very ugly picture. Yeah, just look at India and what happened there. Monsanto came in bought up all the seed companies and then changed everything over to GMO and patented seed. Drove up seed prices, injected tremendous amounts of poisonous materials to control weeds and pests with increasing crop failures and India suffered until they took action. http://www.youtube.com/watch?v=LFF96-wrtUM http://www.youtube.com/watch?v=KmIBvA1Tf20 http://www.youtube.com/watch?v=5o-87znu24E Or here is a full length documentary with Vandana Shiva http://www.youtube.com/watch?v=87qrTXZaXkk |
