An Idaho man banned from wearing a bunny suit in public might have a legitimate constitutional complaint under the First Amendment freedom of expression, the ACLU said Wednesday.

William Falkingham, 34, was told by police he could no longer wear the suit around his Idaho Falls neighborhood after neighbors complained he was frightening children.

The Idaho Falls Police Department received complaints on Monday that a man in a black bunny suit was hiding behind a tree and scaring small children, according to the station. One neighbor also reportedly told police that the individual pointed his finger like a gun at her son. Authorities then responded to the scene and told Falkingham he could no longer wear the costume in public.

The local ACLU chapter told FoxNews.com on Wednesday that Falkingham's right to free expression may have been violated.

"On its face, he may have a constitutional claim under freedom of expression," said Monica Hopkins, executive director for the Boise chapter of the ACLU.

But Hopkins said the specifics of the case would need to be further investigated and that the ACLU is not planning to get involved.

"We have not been contacted by the individual and as of right now," she said, "we have no plans to get involved."

What a freak. If some creep was hiding behind a tree in a costume trying to scare my kids or any kids, then making a gun with is fingers and pointing at them, he would be getting hurt really bad. I would literally knock the sense back into him then back out of him several times.

There was a sick Chester the Molester cartoon where he was dressed like an Easter bunny trying to lure and abduct children.

If the guy was walking down the street in a bunny costume drinking an Arizona iced tea handing out leaflets for a play I would not see that as an issue.

The problem is his conduct and that is something the ACLU is not seeing! So I can go down the street in a ducky costume acting menacingly towards small children and that is acceptable?

Being what I would consider sane I would say "NOT."

Falkingham told cops that "he enjoys wearing the suit," but he understood his neighbors' concerns.

At least one neighbor, Deborah Colson, has hopped to Falkingham's defense.

"He's got the bunny outfit, a cowboy suit and a ballerina dress but you don't see him except where he's tripping through his backyard," she said.

"He's never done anything wrong but wear his little suits in the background," she said. "He's got a strange lifestyle at home but we all do weird things at home. It makes me so sad: people don't even do anything and they get laughed at."

Laugh while you can! This could very well lead to his sneaking into Idaho airports dressing in that bunny costume while trying to pick up Congressmen. Or shooting wolves from helicopters in Sarah Palin drag. Or even :gasp: burning flags in back yard dressed as Betsy Ross.
