Obama administration to issue transgender restroom guidance to schools

WASHINGTON (Reuters) - The Obama administration will tell every U.S. public school district on Friday to allow transgender students to use the bathrooms that match their gender identity.

The letter, signed by officials from the Education and Justice departments, does not have the force of law but contains an implicit threat that schools which do not abide by the Obama administration's interpretation of the law could face lawsuits or a loss of federal aid.

"There is no room in our schools for discrimination of any kind, including discrimination against transgender students on the basis of their sex," U.S. Attorney General Loretta Lynch said in a statement.

"This guidance gives administrators, teachers, and parents the tools they need to protect transgender students from peer harassment and to identify and address unjust school policies," she said.

The move comes as the Obama administration and North Carolina battle in federal court over a state law passed in March that limits public bathroom access for transgender people.

By passing the law, North Carolina became the first state in the country to ban people from using multiple occupancy restrooms or changing rooms in public buildings and schools that do not match the sex on their birth certificate.

"No student should ever have to go through the experience of feeling unwelcome at school or on a college campus," Education Secretary John King Jr. said in a statement.

The Obama administration letter will say schools may not require transgender students to have a medical diagnosis, undergo any medical treatment, or produce a birth certificate or other document before treating them according to their gender identity.

Americans are divided over which public restrooms should be used by transgender people, according to a Reuters/Ipsos poll, with 44 percent saying people should use them according to their biological sex and 39 percent saying they should be used according to the gender with which they identify.

White House spokesman Josh Earnest told reporters that the administration would not take action to withhold federal funding while the matter played out in courts, a stance applauded by the state's governor and a top Republican lawmaker.

"Today the Obama administration admitted what we have said all along - that their threat to withhold funding and bully North Carolinians into accepting their radical argument that men have a 'civil right' to use women's bathrooms and shower facilities would have to be settled in court," state Senate Leader Phil Berger said.

So why don't men receive some kind of affirmative action bump to draw them into teaching?

I mean "minorities" and women have all sorts of laws to help overcome "discrimination" since so many institutions, agencies, departments, businesses, are "too white" or "too male" or "not reflective of america" or whatever.
Yet something like 3/4 of teacher jobs are held by women.

So...if there is "no room" for any discrimination "in our schools" then where has the great fed equalizer been on this?

so I guess ... if the line for the women's bath rm is long and no one is in the men's rm... a women is not allowed in the men's rm ... to late if I have to go... I have to go ... I will use what ever bath rm... as long as there in no one in there ... and this state has lost a lot of business over this ... and I believe the transgender person... should be allowed to use the stall in what ever rest rm... they are trying to be ... male or female ...

RUSH: Could somebody explain to me why transgender people have become so important to Barack Hussein O? I'm serious. From these edicts that transgender bathrooms now have to be built in public schools... How does it look now?

Remember when a lot of people took their kids out of schools to start teaching them at home, and remember how they were called a bunch of fruitcakes and extremists and paranoids and all kinds of names? How do they look to you now? They look somewhat prescient, do they not? I mean, you look at what's going on the American public school system. But what is it with this transgender push? I know that most of the story is that the gay movement has realized its agenda, so they've gotta they've gotta transfer that energy somewhere and transgenders is the next.


I mean, I warned you of that way back in April of last year, and I'm gonna remind you of that warning in moments. But beyond all that, what is this? I mean, these are really, really extreme actions. It's the equivalent of asking or suggesting that men should have visitation rights to girls' bathrooms. I mean, to go all-out here and make this Title IX, trying to claim it's Title IX in one instance and then Title VII of the central Civil Rights Act in another, when it's not even mentioned? In the Civil Rights Act and all the Title IX legislation, there's not a single reference to transgendered people, less than one half of one percent of the population.

So what's going on?

Is all this being used as a smokescreen to distract from us other things the Regime is doing? And do not doubt that one. Do not doubt this is designed to get all the social issues people all ratcheted up and loaded for bear and energetic, to start writing pieces and going on TV to talk about it, while the Regime is over here unobserved doing whatever it is that's really on their mind. So is this just a distraction? Why impose this on schoolchildren? Now, look, I can hear some of you screaming: "Rush, you know the answer to this. You're the one that that's told us.

"This Obama trying to transform the country. This is payback. This is cultural overthrow." Yeah, I know it's all that. But why? And who put Obama in charge of sexual education, and why this issue? Is it about continuing to get gay money for the Democrat convention and the election? Is this about fundraising? 'Cause there's not much more to do on the gay agenda. They got gay marriage, and we're close to putting you in jail if you won't bake a cake for a gay wedding. We've got pretty much everything, but you have to keep the group happy.

I mean, the militant leftist gays, you need their money. Is that what this is? I mean, this, obviously, is important to Obama for some reason. It affects every public school in the country, and as you sit around... You know, I analyze people's ideology, and I know leftists and liberals like the back of my hand. Obviously, they're trying to bring it in and make it the mainstream. This is bizarre. Don't tell me, for example, that somebody like Trump is not presidential when this kind of stuff is going on. Obama is presidential as defined by this kind of stuff? Ordering open bathrooms in schools and demanding that a new bathroom is a little bit different than what's going on in the states of North Carolina, for example. They are actually -- in the schools -- demanding that the districts build a third bathroom: One for boys, one for girls, and the other for whatever you think you are today, I guess.

Is this an effort on the part of the left to encourage people who might be confused about their sexuality to remain confused because there's some sort of political benefit? You're confused about your sexuality and government's got all the answers; is that what this is? Why isn't this offensive? We hear Trump says this -- or any other Republican, take your pick -- and they say, "It's offensive! That's over the top." Why isn't this? I mean, this is so far out of the mainstream, and yet there aren't a lot of people that want to buck this.

I had a story. I've actually done it twice. I had it in the Stack on Wednesday. Let me get to it. Let me see if I saved it. I did; I'm sure. Here it is. Is it second in the...? Yeah, I mentioned this. This goes back to June of 2015, almost a year ago. It's a Cybercast News Service story. "Johns Hopkins Psychiatrist: Transgender is 'Mental Disorder;' Sex Change 'Biologically Impossible.'" You remember when I did this story originally? It's about a doctor, Paul McHugh, and I said, "This guy has no idea what he's in for now," and nothing's happening to him.

"Dr. Paul R. McHugh, the former psychiatrist-in-chief for Johns Hopkins Hospital and its current Distinguished Service Professor of Psychiatry, said that transgenderism is a 'mental disorder' that merits treatment, that sex change is 'biologically impossible,' and that people who promote sexual reassignment surgery are collaborating with and promoting a mental disorder. Dr. McHugh, the author of six books and at least 125 peer-reviewed medical articles, made his remarks in a recent commentary in the Wall Street Journal," which is where this all originally ran.

Cybercast News Service just saw it and decided to do a piece on it. It was an op-ed piece in the Wall Street Journal last year/last summer, and in the op-ed Dr. McHugh "explained that transgender surgery is not the solution for people who suffer a 'disorder of "assumption"...'" That's in quotes. It's a medical term, his term. It's "a 'disorder of "assumption"' -- the notion that their maleness or femaleness is different than what nature assigned to them biologically.

"[Dr. McHugh] also reported on a new study showing that the suicide rate among transgendered people who had reassignment surgery is 20 times higher than the suicide rate among non-transgender people. Dr. McHugh further noted studies from Vanderbilt University and London's Portman Clinic of children who had expressed transgender feelings but for whom, over time, 70%-80% 'spontaneously lost those feelings.'" A-ha. We may be on to something here. Dr. McHugh and his boys have studied all this, and young kids, 70 to 80% of them, eventually grow out of this confusion. Maybe that's what they don't want to happen is for kids to outgrow it.

I think whatever is going on here, folks, one part of it has to be that this is a made-to-order issue for the left and for Democrat Party to be able to point to Republicans -- once again -- as intolerant and insensitive and unfeeling because these are human beings and they can't help who they think they are. They can't help who they love. They should not be punished for it, and it's a built in... They might say it's a built-in opportunity to once again trash Republicans and conservatives. But whatever, it's over the top, and I'm just asking:

What the heck?

Obama has said time and time again that people who EVEN question the cause of climate change are ignoring science.

I guess since he is ignoring the biological definition of sex identification then he is either doing what he claims others are doing....or he is declaring that biology isn't a science anymore.

One state was moving to legalize high school girls to carry pepper spray in response to this. That's a bad idea for multiple reasons and the kind of BS this stupid law will bring around.

Mark my words, someone is going to get seriously hurt or killed over this and all hell is going to break loose.

Transgender Bathrooms Are Not the Issue

The national debt is $20 trillion and counting. Medicare and Social Security are going bankrupt. ISIS is at our doorstep, the federal government threatens to confiscate guns from peaceful gun owners, and health care is being ruined by socialized medicine.

And yet we’re fighting over transgender bathrooms in public schools.

When historians look back on the whole history of the American republic, and contrast it with the early twenty-first century, which may prove its waning years, what will any honest and objective observer think and conclude?

The Obama administration told public school systems across the nation on Friday to allow transgender students to use the bathrooms and locker rooms that match their gender identity.

The directive, from the Justice and Education Departments, comes just days after the federal government and North Carolina sued each other over a state law that Gov. Pat McCrory signed in March.

That ordinance requires transgender people to use the public bathroom that corresponds to the sex on their birth certificate. It applies to schools and other public accommodations.

“The last time I checked, the United States is not ruled by a king who can bypass Congress and the courts and force school-age boys and girls to share the same bathrooms and locker rooms,” said Phil Berger, the Republican Senate leader in North Carolina.

Actually we are ruled by a king. This is not the first time Obama has used executive orders to bypass legislation or debate. He knows he’s right. He does not care about the needs, wants or concerns of anyone who disagrees. It’s not only on this issue; it’s on Obamacare, guns, immigration, fiscal policy and everything else.

This is what you get when you have a public school system. Another word for public school system is government-run system. If we’re to entrust the federal government with command and control of all primary and secondary education in the country, then this is what you will get.

People will turn this into a debate over transgender. But that’s not an issue for the federal government, or any state government, to settle. Neither are bathrooms. Bathrooms are among the most private of private property. We don’t need government determining the make-up or use of bathrooms. But we have given the federal government the power to unilaterally determine what goes on in most schools. Bathrooms are part of those schools. Obama is simply saying, “I run the federal government and the federal government runs the schools. So I’ll do what I want.” And people worry about Donald Trump being a dictator? We already have one!

It was left to one U.S. Senator to state the obvious:

“This is the kind of issue that parents, schools boards, communities, students and teachers should be allowed to work out in a practical way with a maximum amount of respect for the individual rights of all students,” said Senate Education Committee Chairman Lamar Alexander of Tennessee. “Insofar as the federal government goes, it’s up to Congress to write the law, not the executive departments.

That’s true, so far as it goes. But not with Obama. Obama is the same president who unilaterally turns the Obamacare law on and off, or delays its implementation, to suit his favored companies. He’s the same president who got angry when Congress would not comprehensively change our existing immigration laws, so he unilaterally changed them himself. He’s the same president who talks openly of altering gun laws and even tax rates via executive order. What Obama seeks to do with his self-assigned, unlimited executive power is of great concern; but of even greater concern is the fact that he uses this power, almost without restraint. Where’s the outrage over that?

Obama, like his fellow progressives, are really just dictators. They think they can establish peace, harmony, and justice (as they define it) by imposing their will on people, whether they like it or not. He thinks he can change minds by pointing a gun to their heads, as with transgender bathrooms in rural Texas and Mississippi. Instead, he’s dividing the country and stirring up untold dissension, the kind of which led up to the Civil War in the 19th Century. We cannot go on like this. Governments exist to protect people from criminals and otherwise stay the hell out of people’s lives. This has been truer in America than anywhere else on earth. Imposing social and economic policies, Communist-style, from above will not be tolerated by all Americans, not forever. We’re heading towards calamity, on our present course, because we have allowed ourselves to abandon the principle of limited government. That’s the real issue here; not transgender bathrooms.

Progressives are so inconsistent; it’s almost funny. When you draw a cartoon or even utter a word offensive to Muslims, and they reply with brutal acts of violence, progressives say: “Well, you got what you deserved. You shouldn’t offend them.” But a lot of people find transgender bathrooms offensive, just like some people will find anything offensive. By telling these people, “Tough! We’re the boss and you’re going to do what we say!” you’re not instilling loyalty, reason or anything. We’re supposed to walk on eggshells around Muslims, or any other group progressives consider above criticism, yet millions of Americans are expected to toe the line with Obama’s one-size-fits-all, command-and-control edicts emanating from Washington DC.

Schools are supposed to be about educating young minds, not imposing government propaganda (either from the left-wing or right-wing perspective). We’re supposed to teach young people how to think, not to follow orders. But following orders is what governments require young and older people to do. We would have been so much better off if we had left government to the role of pushing criminals around rather than pushing all the rest of us around. How much more of this will Americans be willing to take?

Well, I think he did it as a favor to his friend Bill Clinton. Now he doesn't say oopppsss I walked into the wrong bathroom anymore when he is out trolling for sex.
