Topic: Missing w-2 form (tax Question)

Okay so.....

Back in Jan.'08 my boss was going out of business.A new guy took over in Feb. of 08.

Today my new boss spoke with me and told me that if I forget about the old bosses couple of weeks of employment and just file with the new bosses w-2 that I would get more of a return back. At first I told him noway ,that I did'nt want to do anything illegal and that I did'nt want to just blow off a month of employment as I paid taxes then. He went on saying it wasn't illegal and it would take him longer to produce both w-2s and it would benefit everyone. So I agreed.
Now thinking about it, I'm about to disagree cause it sounds to fishy. I don't know if this is something so small it will be overlooked by the IRS. I do have ALL my paystubs from the entire year. I'm thinking.. just get the one W-2 and those four paystubs from January and go see my tax worker...and let her figure it out. I also don't want to be involved in an audit or giving my new boss any trouble as I need my job. Any suggestions?

Actually, what he is doing is highly illegal. You could also get into trouble for not reporting income.

As small as the situation is....it is illegal to do.
Any work that you perform must be on the books and documented.
If he is telling you not to report that time, the taxes he took out of your check ... he pockets....
How many others is he 'asking' this favor for?

Also, if he does not come up with a W2 by Feb 15th, you can report him and he gets fined.

Thanks Becca...I knew something seemed fishy I told him no first that he gave some b.s. about claiming less wages and more child credits on some scale noway

He is trying to get you to break the law by making EIC seem like a better benefit than claiming the other wages. As long as you have your last pay stub, you can file. They can find you old boss's EIN number and file for you that way. If you have a past return with the former EIN number, that would help.

My thoughts on it too. Go with your gut. It seems like he's doing something that could put your azz on the line but maybe would help him. He's obviously looking out for only himself. Now you have to look out for you.

Even if he doesn't give you a w2 you are still obligated to report the income. Unfortunately he has put you in a bad situation since, although you can probably figure out how much you were paid, unless you kept your pay stub you won't know how much taxes you paid in.

I'd give him one chance to come up with the w2... by the end of January. Then I'd report him. Whatever the case, don't let it keep you from filing your taxes or filing for an extension. And you can call your local or regional IRS for advice on how to proceed.

yeah Sweet I do have the last paystub and all my stuff from last yrs return...thats what I think I'll do (but first I'll tell him I want the w-2)

yup Jill he is crooked ...I think he's trying to help out the old boss( their buddies) but the old boss guy is already in a heap of chit with the IRS.

Tngxl~ Ty for the suggesstion...I am going to talk to him & tell him I want it after all but I do have proof if he trys to talk me out of it or refuses to produce it. I have been on the IRS.gov. website reading up on things and I have a friend that I'm gonna talk to also. Thanx everyone!
