Illinois law you need to get a temporary custody order in court til the
divorce is over. so this means that he/she has equal rights to the kids
and can take them any time!!!!! they can also take the kids and then go
right to court and file restraning order or even temp cusdody order Who
ever has posetion at time of filing. untill you get this filing for
divorce does not give you custody, or child support.

if your husband was served then your attorney filed and your first court
hearing will determine temp custody and child support brighteyes.He
can't just take the girls out of the house unless you give him
permission.Barbie is right the abusive ones like to play mind games and
drag things out and could give 2 ****s about the childs well being.And
the courts let them.

for htose who have not had the court order custody, even temporary...

Do nt leave the kids with anyone where the absent parent can find them,
cause the police will walk in and remove them to give themto the absent
parent without the court papers.
I went through it myself.

If you have to work and leave them with a siter, do so where he is
unlikely to know htey are there, or he can get the police to retrieve
them for him while you are at wrok and nothing can be done about it. Of
course once theres a court order, even tmeporary make sure the sitter
has a cpoy of it in case the ex tries it anyway.

well my son was at my parents house and my ex tried it.the cops said he
was tresspassing and could be arrested.The police cannot walk in and
take a kid from the sitter on one parents say so.A court order is needed
at least here.

I thought having a baby was suposed to be a happy time in your life and we have to deal with this crap im going through the SAME thing im stressing out big time on what his father will do even though he has not seen him in 5 months my son is now 8 months old. we are due in court on nov 29 and im getting myself sick over it.

JENNY81 don't let it get to you like that. What I was told is to just document everything so you can present it to the judge if needed to prove you are the parent that should obtain custody. I am sorry you are going through this but if you are clearly the one giving the child care and being a real parent I would think you shouldn't worry.

You need a legal stand yes, ...he can fight you but if you get in first, you will be ok till it goes to court. What I mean is that when the child is in his care he can't file for custody on ya and keep your son while you wait for court cases.

Custody battles I hate.....good enough for the man to donor, then why can't they have equal rights as the mother unless the child's safety is at risk.

Try and put aside your differences and think of the child, they are always the ones that suffer in these battles. Ego will never give any child a good future, you will find most that battle for kids custody their children are never better off most repeat history and it SUCKS!!!

I do agree if the child's safety is at risk, that is Priority and I support the act.

I just played it safe and sued him for sole legal custody!! No matter what it is always better to have it on paper incase things get down to the nitty gritty.....
