The US House of Representatives has voted to allow the transfer of detainees at Guantanamo Bay onto US soil so that they may face trial.

The greenlight came in a $US42.7 billion ($A46.7 billion) 2010 spending bill for the US Department of Homeland Security, which cleared the House by a 307-114 margin.

The legislation forbids the release of current detainees at the US military base in Cuba onto US soil, and forbids their transfer to the United States except to face trial and only after a detailed security assessment.

US President Barack Obama's administration would have to submit a plan detailing the risks involved and what steps to be taken to diminish the potential threat.

The plan would have to include the legal rationale for the transfer, as well as the US attorney-general's certification, two weeks before a transfer, to the governor of the receiving state that the individual poses little or no security risk.

The legislation, which must still clear the Senate, also says the detainees cannot be sent to another country unless the president gives Congress the name of the detainee, the destination, a risk assessment, and the terms of a transfer.

Of the 223 people still held at the controversial prison camp, about 80 are waiting to be released and a further 60 are expected to be prosecuted.

Why can't they set up trials there instead of bringing them here?
I personally don't want them setting foot in our country.

They don't need to set foot on our soil.

There is no reason not to have the trials there.

Can you imagine what will happen having them in our jails here? Retaliation, you watch. In one way shape or form there will be retaliation for them being here and demanding their freedoms.

I dont feel scared by putting them in prison. We have had terrorists in max security prisons here before.(Timothy McVeigh and the first World Trade Center bombers from the 90s) If they are guilty then proving it at a trial won't be a problem.I feel that our Constitutional way of doing things is the strength of America.

I'm not scared but it highly concerns me if all the men are tried on American soil. yes we do have some terrorists already in jail. A lot has changed since 1993. They are known to hijack and bomb in other Countries to have their fellow terrorists released. Have we forgotten 9/11 so quickly to think that it can't or won't happen again? Having them here will cause problems.

But they do not deserve OUR constitutonal rights!!!!!!!!!!!!!

Nothing has changed. Terrorism is the same terrorism its always been. What you are proposing is like saying we shouldnt keep money in banks because it attracts bank robbers. We dont let the terrorists push us around and tell us what to do. That is what they want. We need to stop letting them control us

In a lot of cases it was actually the CIA (The Cocaine Infiltrated Agency) that made the arrests

nah what killed the country is that over half the detainees at GTMO were rounded up illegally and never committed any crime. Do you condone that?

the issue isn't keeping them in prison.. the issue is putting them in an environment where they can prosthelytize to a captive audience of felons and spread their anti-American hatred..
