Good evening my mingle2 family, shots out to all my " Vocal Avengers" who follow my topics luv ya' all....okay, I'm curious on your feed back on this one. Okay last night I was the trolley car on my way home, I'm in the front seat, zoning out the world with my headphones on listening to my music, and the trolley was somewhat crowded, but its was a few seats available. A man comes on the trolley, very intoxicated, loud, lude,& making a fool of himself. He actually stood right in front of me talking loud, dropping money all over the floor, singing, smelling like his favorite beer. Most people on the car laugh at him, but I can see the trolley driver was getting very annoyed by his actions. My question to you guys is if somebody's too intoxicated to conduct themselves get on your local mass transit system is the driver obligated to pick up an intoxicated fare or does he/she have the right to pass them by? Now keep in mind on the positive hand maybe he or she at least not driving , not putting people lives in danger. The negative, well belligerent, profanity ridden antics shouldn't be accepted especially if young kids & elderly aboard. Okay now's its your time to share, what do you think? Lets talk......

Hey eyeam,
I think you are posing questions on two separate scenarios.
One public and one private.

On the public side, the mass transit is a public facility offered to the public. A major part of it existing is to provide service to the general public. All public facilities have rules that must be followed for the public to use them.
No firearms in court is a good example. No chopping down trees at a national park is another.
Since we have laws against driving while intoxicated, there will be times when someone in such a state will use public transportation. Most times, that will not be an issue.

On the private side, if someone is acting in such a way that is offensive or dangerous to others the police are available to protect and serve. In your example, if the intoxicated person were being so offensive the driver could not operate the bus safely, he should ask the offender to vacate the bus.
If the offender does not, the police should have been called to remove the offender from the bus to protect the safety of the other people on the bus and in the streets where the distracted driver must drive the bus.

So simply put;
Sit down and shut up or get off the bus, by choice or by force.

Well my look on this well, I was a little annoyed by his behavior, but I saw the bigger thought, at least he didn't drive while lit. That would of been tragic in so many ways. I guess if you paid your fare and you might of parted too much, well, you doing kind of the right thing by not driving. we live in a wacky world, oh I'm tell you how you survive crazy, intoxicated, or insane folks. The key to wanting to be left alone by these individuals is always agree with them and the leave you be.......LOL.

I have put a friend out of my car, told him to walk home, because he was drunk and belligerent while my girlfriend was in the car.
The bus is not the only form of locomotion.

The main issue tho is not your comfort or the comfort of the other passengers. The issue is the distractions of the bus driver and the fact that those distractions caused by the intoxicated person and/or the resulting commotion of the other people could jeopardize the safety of the trip, both for the passengers and the people in the street.

Depending on the situation, the bus driver should have called the police and not moved the bus until the situation was rendered safe.

Hi, welcome back , okay....really?....I'm mean really?....I mean watching this guy was annoying but again, I'm glad he wasn't driving. let me ask you this? If you drove a bus or trolley car and somebody was intoxicated aboards, acting quite lude, would you pick up this person or pass them by?

I would know that how someone acts in one place doesn't mean they will act that way in another.
As a citizen, they all have the right to get on my bus.
If, once on my bus, they are a problem that distracts me from safely operating the bus on public streets, I will either not move the bus till they settle down or I will call authorities to remove them from the bus.
To me, that is not a difficult decision.

simple...driver radios in to local police or transit police

Judge:
count 1. public intoxication...guilty as charged
count 2. disorderly conduct....guilty as charged

$500.00 or 50 days in the county lock-up

Bailiff, call the next case...

Hey, drunks need to get home too ...lol

I think if someone on public trans is disturbing the peace they should be given the chance to pipe down, and if not, there should be discretion to ask them to leave, though I dont know how you would MAKE them without doing something illegal (assault) yourself.

One of my brothers ( before becoming a fireman) was a NYC bus driver... he hated that job. But many times loud drunks would get on making a scene.

My brother ( as trained to) would just radio for the cops. The cops would have the guy off the bus within a very short period of time.

Was he committing a crime ?.. no.. but the person was disruption the quality of the other riders journey.. and in NYC, that is enough to get you yanked off the bus.

Sometimes the cops would yell at the guy and tell him to sit down and shut up!!! and if that warning did not last long, then the cops waiting at the next stop were not in a good mood.

simple really if the drunk is over the tops and either impeding the driver or disturbing others then said driver has right and duty to stop/ not start and either eject or call for help to remove said drunk.
now if he's simply a clumsy happy drunk not interfering with others or safety then sure let him ride home

If it's a public transit system, then yes, IMO, there is an obligation.
If they were a private company, no, no obligation. I believe in the whole "we have the right to refuse service to anyone" for private businesses and private property.

Other than that, I don't see why the bus driver can't contact dispatch, have dispatch call the cops, and the cops come get them at the next stop or so, for drunk and disorderly.

Welcome back to cyber mansion, wow your brother being a transit driver is a great career but I can see it can be quite crazy at times. I guess if I was a bus driver a fare gets on drunk and loud I would have to warn him or her to be seated or you will have get off the next stop. See as the driver I have a certain responsibility to keep my riders safe. you paid your fare you should have a certain amount of peace while riding.

You hit the nail in the coffin yes I agree with your statement transit drivers do have a small responsibility to make sure riders are safe to there destinations. its a wild world we live in , drunks on a trolley is to me a bit annoying.
