"And it's so appropriate because she's Indian. ... So she would be in Dick-in-sh-- ... walking along the street."

is much different than a statement using a metaphor about a general group of people while LAUGHING

the reason,,,CONTEXT and the fact one is PERSONAL and the other is GENERAL

I'm surprised this thread is still alive... no strangleholds on it yet?

well there have been no 'PERSONAL' attacks,, just generalizations

how ironic is that....laugh laugh laugh

lol it's because bidden is a no name loser that nobody knows anything about...

that may be the case, but mostly its because speaking in metaphors is not illegal, anymore than making false claims about how tough one is or what they can or would do to someone else IF,,,, some tough guys sure get sensitive about OTHER guys acting tough,,,,

odd

yea, that why i didn't get involved to much... in Texas, if someone has a gun and says I'm going to shoot you, that is attempted aggravated assault. without a gun, it is nothing...seems that a generalization is not a crime, but a statement... with all the lawyers in Washington, someone might know what the laws are...

Actually if they make the comment and appear to reach for something or act like they have something you are justified to kill them. Hell in all states if you are in fear for your immediate safety you can react.

and who will be around to refute whether the gunman THOUGHT he saw them make a move,,,,its essentially a right to kill,, without true justification

The evidence and forensics doesn't lie. You can usually tell when you talk to or interview them if they are in fear or not. The night I had the gun pulled on he I shook for hours and was on edge for quite a few days. Hell I wouldn't even approach and apprehend shoplifters for close to two months after that. I stuck to internal and Human Resources investigation until I was comfortable. Then they put me with a partner for about six months after that(we never worked partners, that's counter productive when we covered twelve stores and there was only four of us)

DAYTON, Minn. -- Vice President Joe Biden has told Democrats at a Minnesota fundraiser that he'll "strangle" members of the GOP who complain about the federal budget.

According to a pool report from Tuesday's event in Dayton, Biden was telling the crowd that Democrats know how to balance the budget. He said, "If I hear one more Republican tell me about balancing the budget, I am going to strangle them."

He quickly added: "To the press, that's a figure of speech."

Biden joined former Vice President Walter Mondale at the fundraiser for 350 people paying at least $150.

Earlier in the day, Biden spoke at a rally at Macalester College in St. Paul and focused on the Obama administration's efforts to turn the economy around.

THere is a nice picture showing how evil the man is at the link. That is a Felony threat and I want him brought up on charges. I am a Republican activist and I fear for my safety with that remark.

Any other person who says they will strangle another would be in jail facing Felony charges, he should be held to the same standards.

Our society is so upside down.

It can be seen by whats on peoples minds because those who rule us steer us in the direction of thought and whats right and whats wrong.

Stuff like what Biden said is so trivial.. Who cares he even said its a joke.

But we worry about being offended all the time.. he is making me uncomfortable arrest him.

can anyone post a definition from a LAW source of what a 'felony threat' consists of please?

I found only this

A mere argument is not enough to constitute a threat. For a threat to be a crime, it must be a threat to do physical harm. Threats to murder or cause serious injury to a person are specific enough to be the basis of a crime. Threats to divorce, end a friendship or make trouble for someone are either not physical or not specific enough to constitute a crime. California Penal Code Section 422, like many similar state laws, provides that for a threat to constitute a crime it must be a threat to commit homicide or cause serious physical injury.

Read more: Legal Definition of a Verbal Threat | eHow.com http://www.ehow.com/about_6472094_legal-definition-verbal-threat.html#ixzz11nyGrI4H

now, I guess people can make the argument that this official was actually THREATENING to threaten a republican(in general, any republican actually who asked a certain class of question)

but I do believe such people are PANSIES who dont walk their own talk and would end up in jail themselves if the same standards were applied to them because EVERYONE has used such figures of speech at one time or another and others have actually stated that they would harm people and not meant it as a figure of speech in these very threads

the courts do not need to be backed up with such cry baby antics, if Biden makes a direct threat against someone,, maybe , but this type of general statement would only be taken literally by people who WERENT there when it was said and want to nitpick about something

Below are two examples from the quick on line research I did. These two examples were chose from my on line research because they are brief but the criteria is nearly identical to all the other information I found.
http://www.suite101.com/content/when-to-hire-a-personal-injury-lawyer-for-assault-or-battery-a276873
When to approach a Personal Injury Attorney for Assault?
The following 3 conditions must be fulfilled to make a case for assault under personal injury law:
• The defendant must have communicated an intentional threat to cause physical injury to the plaintiff by force.
• The circumstances should be such that they warrant a reasonable fear of danger in the mind of the plaintiff.
• There must an existence of the apparent ability to execute the threat in absence of any preventive action.

http://www.legalinfo.com/content/criminal-law/crime-overview-assault-and-battery.html

Words alone, regardless of how insulting or provocative they are, does not justify battery or assault.

In the United States, assault is commonly known as a crime against another person using, or threatening the use of, violence. Battery is typically referred to as a crime when unlawful contact is made by another person. In most states, there is no differentiation between the two. Sentencing for this crime varies on the severity.

Assault and battery differ among the various jurisdictions in the United States. Generally, assault and battery occur either when a person physically strikes another person, or one person acts in a threatening manner towards another person.

Assault involves:
1)An intentional, unlawful threat to cause harm to someone else by force;
2)Creating circumstances that cause fear for another individual;
3)Ability to carry out the act if it is not prevented.

There were a few states that also required a further criterion - the person threatening was brandishing a weapon AND was making the threat directly (in personal contact) with the person or persons being threatened.

If he threatened a reporter without cause then he should be arrested. Some reporters push their limits, I have working special events actually push people down to try to get closer and getting pictures.

It also depends on the level of the threat. If someone thretens to strangle someone else that is a life or limb threat and needs to be dealt with.

He's on video saying to the reporter "I'll take you out."

Myself, I always thought that like WorldNetDaily preaches, "A free press is essential to a free people". But here we have a Tea Party candidate loosing his cool and trying to intimidate one of our corps of the bulwark that insulates us from having a government that answers only to itself.

So, if you're going to be Mingle^2's equivalent to Fox's 'Fair and Balanced' reporting, why, as the biggest initiator of news threads in this forum, did this escape your notice? When Biden's pretty tame-by-comparison gaffe didn't?

I know the codes here in Nevada. There is no grey area, if someone feels threatned is a criminal offense PERIOD.

THERE IS NO GRAY AREA?? PERIOD!!! Well, let's see,

http://www.shouselaw.com/nevada/harassment.html

The Legal Definition of "Harassment" in Nevada Law
Harassment in Las Vegas is an extremely general crime that comprises many possible actions. Broadly speaking, to harass in Nevada means knowingly to threaten someone else with harm so that person reasonably fears that the threat will be carried out. Such harm may include:
• Bodily injury,
• Physical damage to property,
• Being restrained or physically confined, or
• Anything else intended to substantially harm another person's physical or mental safety.

In order to be considered harassment in Clark County, the threats can be made by words or conduct. It's also considered harassment to threaten one person to harm another person, such as threatening a mother to hurt her baby. And the injury being threatened doesn't have to be immediate—threatening to do harm in the future may still be harassment.

Relation to Nevada crime of stalking
Although harassment is a separate offense from the Nevada crime of stalking, they are closely related because they both comprise behavior that causes another person to reasonably fear being harmed. The main difference is that harassment is the direct threatening of harm through words or actions, whereas stalking usually involves trying to force contact with the victim.

Legal Defenses
If you've been charged with harassment in Nevada, remember that you can't be convicted unless the prosecutors prove beyond a reasonable doubt that you're guilty. And since many of these cases have no hard evidence other than the accusations of the supposed victim, it's not uncommon for the D.A.s to ultimately dismiss the case or reduce it to a more minor charge. Some defenses your lawyer can explore using are the following:

• Your actions were in self-defense.
• The "victim" is lying about what you said or did.
• Your behavior did not rise to the level of harassment.
• You were acting under "lawful authority" (such as a security guard or cop), or your actions fell under the constitutional protection of freedom of speech and assembly.

Notice the wording under “Legal Defenses” (If you’ve been charged with harassment in Nevada) – Biden was in Dayton Minnesota when he made the comment not in Nevada and the comment could have applied to millions of people. The comment also invoked a quality of irony and was followed by a direct disclaimer to the press who were reporting on the event.

It would be a paranoid individual indeed who would ‘believe’ that their life was in any danger from Biden. A person of sound mind would not believe that Biden’s extremely broad generalization in a public speech made in another state was specifically directed to the individual who felt threatened.

Apparently no one has felt threatened (in Nevada or any other state) enough to put their money where their ‘fear’ is, because they would surely loose a lot of money trying to prove why there is “reasonable fear that the threat will be carried out”.

1)An intentional, unlawful threat to cause harm to someone else by force;
2)Creating circumstances that cause fear for another individual;
3)Ability to carry out the act if it is not prevented.

There were a few states that also required a further criterion - the person threatening was brandishing a weapon AND was making the threat directly (in personal contact) with the person or persons being threatened.

I know the codes here in Nevada. There is no grey area, if someone feels threatned is a criminal offense PERIOD.

THERE IS NO GRAY AREA?? PERIOD!!! Well, let's see,

Apparently no one has felt threatened (in Nevada or any other state) enough to put their money where their ‘fear’ is, because they would surely loose a lot of money trying to prove why there is “reasonable fear that the threat will be carried out”.

thank you,, I thought I Was taking CRAZY PILLS or something,,,lol

can anyone post a definition from a LAW source of what a 'felony threat' consists of please?

I found only this

A mere argument is not enough to constitute a threat. For a threat to be a crime, it must be a threat to do physical harm. Threats to murder or cause serious injury to a person are specific enough to be the basis of a crime. Threats to divorce, end a friendship or make trouble for someone are either not physical or not specific enough to constitute a crime. California Penal Code Section 422, like many similar state laws, provides that for a threat to constitute a crime it must be a threat to commit homicide or cause serious physical injury.

now, I guess people can make the argument that this official was actually THREATENING to threaten a republican(in general, any republican actually who asked a certain class of question)

but I do believe such people are PANSIES who dont walk their own talk and would end up in jail themselves if the same standards were applied to them because EVERYONE has used such figures of speech at one time or another and others have actually stated that they would harm people and not meant it as a figure of speech in these very threads

the courts do not need to be backed up with such cry baby antics, if Biden makes a direct threat against someone,, maybe , but this type of general statement would only be taken literally by people who WERENT there when it was said and want to nitpick about something
