The Wayne County District Attorney's Office will decide Thursday whether an illegal immigrant from Mexico will face more serious charges in connection with the death of a newborn baby.

The Wayne County Sheriff's Department is investigating the death of the infant after an assault on the baby's mother.

Authorities say Juan Martinez, 28, assaulted his girlfriend, Angelica Ponce-Ramirez last week, causing her to go into premature labor.

Ponce-Ramirez delivered a baby girl at Strong Hospital Tuesday. The baby died about an hour later.

D.A. Rick Healy says Martinez kneed Ponce-Ramirez in the stomach at least five times and beat her leg with an extension cord.

Healy says the assault stemmed from an argument in which Martinez claimed he wasn't the baby's father.

"This is really a troubling case," Healy said. "The allegation is at least on the charge, it appears he intentionally assaulted her for the purpose of her losing the baby or the baby dying. It appears that way from the allegation that he struck her with his knee multiple times in her stomach. Being 28 weeks, that was his intent. It appears that way."

Investigators are working with the Monroe County Medical Examiner's Office to determine the infant's cause of death.

Martinez is currently charged with assault. He is in the Wayne County Jail being held without bail.

did any one here about the lady who didnt see her daughter for more then a month and when the daughter finally came home she said she hadnt seen her baby in like a month cause the baby sitter kidnapped her but the mother doesnt really care and isnt talking to the cops about it.....her car smells like a dead body too

According to The Washington Post, more than 1,300 pregnant women and new mothers have been slain since 1990. And a Maryland study published in 2001 in the Journal of the American Medical Association says a pregnant woman "is more likely to be a victim of homicide than to die of any other cause."

Has being pregnant always posed this risk? Did men in the past assault or kill woman to avoid the birth of an unwanted child as often has they do now? Is this actually happening more often or is it just that the media covers it better? DNA technology makes it impossable to deny fatherhood & states are activly pursuing child support, is this a big factor?

This is not really about the accused being an illegal. This is about domestic violence.

The leading cause of death among pregnant women is assault. That fact makes me ill.

Both men and women who commit domestic violence seldom change. It is the responsibility of all of us, mother, fathers and society in general to teach our children that this sort of behavior is unacceptable and to severely punish abusers.

I wonder if Juan Martinez would have been charged with the baby's death if he/she had died in the womb?

It seems that the only prerequisite for an unborn baby to be considered a 'person' is whether it is in or out of the womb.

illegal entry to the country needs to be handled in a more efficient manner that is for sure
