Nope But.......in some states they have to offer them drug rehab if they fight it once they make the program then they will be reinstated for work. But with construction type work they are not required to offer those types of offers.

Some times company policies, created by suits, cost them excellent workers.

No, i don't think this man should have been fired, there should be an appeal & probation process. JMO

However, govt. doesn't need to pass laws on this. Let the insurance industry set the standards for testing & thus the companies are their own enforcers for cheaper rates.

Motorcycle helmets, 1 rate with; much higer rate w/o. Have a card state what type it you have, if caught w/o a helmet; your driving w/o insurance.
You lose real big time. Get the idea.

Freedom of choice, just chose your price.

Yeah but your in construction the insurance rates ect.. will eat them alive. The insurance company’s and the company’s you do work for I'm sure has a lot to do with that zero tolerance policy. Due to we work for AT&T any time someone gets hurt drug test must be done if it comes back positive it is and automatic fire no if's or butts. It is either that or the company losses it's contract. So with that thought in mind you only have one choice on the matter either keep your contract and the rest of your employees or loose the contract and everyone is out of work.

Is it fair to fire one for testing positive not always but would it be fair to loose your company and to have to lay off everyone NOT. So at times we must follow the system.

Actually if the guy's tooth was hurting that bad he should have called in for he was not thinking straight if he was in that much pain to begin with. So all the fault can not go on the company for dealing with Safety is first and foremost.

My friend USED to work for Summit Racing and he went to a weekend concert, had pot, LSD, Acid...everything you could imagine around him at his fingertips...Didn't touch any of it, he did however have gout and took a pain pill for it that was not perscribed. Monday morning he came in to work, there was a drug test sitting on his desk. He took it and poped pos for the pain pill. They asked him if he had an RX for it, which he didn't as he hadn't been to the Dr. yet...(he didn't want to miss the concert) and they canned him.

Is that fair?

I also worked for a temp service (on the inside) and I have some GREAT stories about drug testing some of the people.

I test this guy he pops pos for marijuana, I say "sir, I'm sorry you can come back in 30 days and retest" he says "I have a note" I say "from your Dr. are you on a Rx?" he says "no, from my boi, he was smoking it around me, and I didn't and he wrote a note to say that I wasn't smoken it." I say "Your friend who was smoking an illegal substance wrote you a letter to vouch for you that you were not infact smoking but you were around it" He says "yes ma'am" I say "So your friend who was breaking the law is telling the truth about you not smoking?" he says "yes, ma'am" Needless to say he didn't come back and was quite upset that his note from his "boi" was not legal enough to pass him.

I think the only time a drug test is necessary is if someone is hurt at work, if they test pos, they don't get workman's comp. Other than that, does it really matter?

I don't use drugs and have no problem with drug testing.
