If they get a judgement against you they can get a lien toward you. They can get a judgement to garnish your wages, but they have to do it legal with a court decision

i have been paying on a student loan and went and did my taxes and was told there is a lean against my refund ...if i am paying them why would they do it and can i call and maybe get it lifted

to satisfy your debt, on the positive side, debt will be repaid sooner and you'll be able to collect future refunds.

its a written agreement to pay them so much a month ....i am just not sure why when the payments have been made on time ....would it hurt to call and try to see if they will lift the lein

You can't lose anything for trying but if you have written agreement I'm almost certain on there it mentions the garnishing of refunds.
call them and find out

I'm not an expert, but I would think the lien would be overriding a contract. So if you are making the payments on time and the full payments....I don't see how they could get a judgement.

i didn't say i wasn't paying it back i have been paying it back i just really needed the refund for a car ....

You said it was for a student loan. Have you made all your payments on time according to the loan guidelines?

If so then you need to call them to find out if all your payments have been posted.

For if it happened that you were late or missed a payment then it would cause your loan to go into default. Which at that time yes they can put a levy on your income tax.

But it would be best to call where you have the loan for they should have sent you a letter letting you know you were in fact in default. The letter should have told you that you had so many days to dispute the charges.

Normally Student Loans only have a certain amount of time that the loan has to paid back. How long have you been paying on the student loan that you got?

Do what ever they want to do. You should gather all your papers up and contact a lawyer. If you cannot afford a lawyer write your U.S. Congressman a letter.

Go to the student loan office and ask if they can help you. My suggestion is be nice, business like, and have documentaion of your situation. If your circumstances have changed, someone has made and error, or sometimes with some of the newer rules "exceptions to policy" can be found and formally requested a change may be able to be made.

Since most people blow and IRS refund the advice to reduce your school debt faster is wise.

I would suggest if you are consistently getting more than $200 that you go to the IRS or your employer(s) and ask them how you can reduce what you are overpaying. You are basiclly loaning Uncle Sam money every month by over paying. Very poor money management.

I would also suggest credit and budget counseling. There are many community colleges, churches, and community organizations that offer the service free so DO NOT, I repeat DO NOT, pay for this service.

There are a great deal of assistance programs to help low income earners besides public assistance.

Also the financial counselors at the school you attended can often offer you good resources to have some of your school debt "forgivien." Better employment options and other services are available to alumni.
