John Boehner Is Getting Ready To Mount A Potentially Gigantic Lawsuit Against Obama.

House Speaker John Boehner could file a lawsuit against President Barack Obama in days, in an attempt to challenge the administration's heavy use of executive actions to further its agenda.

Roll Call's Daniel Newhause reports Boehner told House Republicans during a closed-door meeting on Tuesday he could have an announcement in the coming days on whether he will mount the legal challenge. According to the report, he has been "consulting with legal scholars" ahead of his next move.

Boehner's office confirmed the Roll Call story, but declined to comment on whether specific executive actions would be targeted.

Obama, however, has given House Republicans plenty of potential material. He has made 2014 a self-proclaimed "year of action," issuing executive orders on everything from the minimum wage to federal pay discrimination. Perhaps the most controversial administrative-only move this year came in the form of newly announced regulations from the Environmental Protection Agency on carbon emissions.

Republicans have also roundly criticized Obama for taking administrative action to delay parts of the Affordable Care Act, most notably the so-called employer mandate.

In March, the House passed a bill to speed up potential lawsuits against the president. But the Senate has failed to take up that bill, along with others passed by the House that target Obama's executive actions. Boehner spokesman Michael Steel said the Senate's failure forced the House to examine other options.

"The president has a clear record of ignoring the American people’s elected representatives and exceeding his constitutional authority, which has dangerous implications for both our system of government and our economy," Boehner spokesman Michael Steel said in a statement.

Probably won't happen very soon. In a press conference on the subject, Boehner couldn't even identify which, specifically, Obama did that was worthy of filing suit against. He used vague terms like "failed to execute the laws" but seems to be angry about executive actions, in general. Possibly immigration. However, President Obama issues executive actions to direct the parts of government he can command, including at times at the request of Congressmen. Hell, even Boehner, himself, asked for an executive order prohibiting funding for abortions as a condition of getting congressional votes for the ACA.

Basically, this won't go anywhere. Everything the Republicans are angry about Obama doing are things they loved to see Bush doing.

The Supreme Court ruled Thursday that President Obama overstepped his bounds when he tried to circumvent the Senate and install his nominees to key positions but the justices left the heart of the executive branch's recess appointment powers intact.

In a ruling freighted with constitutional implications, the justices said the president must wait for Congress to break for at least 10 days before he can use his recess powers, and said lawmakers on Capitol Hill generally get to decide what constitutes a recess.(read more)

It probably won't go anywhere because Obama hand picked the Judges that would probably be asked to review the case.

A main problem is that Harry Reid is just as crooked as Obama and has his back in all things. No impeachment can result in a conviction.

Personally, I think the House should just impeach Obama for the record. Even knowing the Senate will fail to do it's duty the House should do it's. It's a shame right and wrong don't matter to partisan politics.

I wish Rick Perry would call in the Guard to stop the flood of illegals at the border.

Obama would probably rescind the Order under some pretext,or haul Perry before the UN like he did Arizona!

With Reid running congress, Holder as the top cop, the majority of judges on one liberal corporate payroll or another and the media all but silent when it comes to our liar-in-cheifs bad acts, scandals or corruption within his admin, is it any wonder nothing or nobody ever gets prosecuted for breaking the law, corruption, or anything else..... even killing Americans without due process simply because this POTUS wills it?

"I'm really good at killing people!" But when it becomes controversy, he either "heard about it on the news" or there's always a lower echelon flunky to throw under the bus..... What a legacy!

"We never leave our soldiers behind! Well.... OK.... except for Benghazi.... but you have to understand, I had to fundraise, campaign, and win an election.... I just couldn't be bothered with that.... but we did pick up their pieces later!"

"Now, let's talk about something important like granting amnesty to 12 million illegal aliens and potential democratic voters.... I have a pen and a phone..... remember!"

Boenher or is it boner, should be good on everything but the EPA. They have an administrative function as an agency that is different than just say....creating a whole new healthcare beaucracy that no one voted on.

I think the EPA rules were already in place anyway. In the case of the EPA it is nice to actually see him enforcing existing law somewhere. Now he just needs to get some legislation passed to prevent utilities from artificially jacking up service charges like spoiled spiteful little children cuz they don;t like it. Please. My local electric utility posted a 1.94 bil profit in 2012 and STILL charges us for storm damage in 2011. The existing energy bureaucracy is running scared. For good reason. They haven't been doing their home work.


But as far as this lawsuit, it is kind of ridiculous because procedure requires a no confidence vote for impeachment. Can we please ask a high school social studies class somewhere to run the country? they may be better acquainted with the rules...lol

Forget about cheap utilities. The fossil fuel corporations are killing that possibility with Obozos' regulations on the coal industry.

Of course they'll have taxpayers throw billions at green energy that is too expensive for commercial use by regulations already in place, and silence ingenuity that actually works economically or cheaply as "unsustainable", to expensive, or irrational.

After all, if we don't need war to steal another nations resources our biggest industries (gas and oil, military industrial complex) would lose their profit shares.... and control of govt!

Climate change isn't a hoax, just the way govt says it's OUR fault.... while the corporations pollute the world.

Maybe if govt quit messing with nature our climate would stabilize, but nature happens as it has for millions of years.

50 years ago we were going into an ice age. 10 years ago we were going to burn up. Both wrong of course. So now they call it "climate change", blame it on the people, tax them for breathing or cutting farts, and when it changes again they'll claim it's working (thanks to them) or give us another scare they can tax further.

Which ever they do, the problem will be the Justice Dept. Holder won't prosecute Obama or anyone that sides with Obama.
Better to go the cut off funding route starting with the IRS first.

First, the Republicans were gleeful that the Democratic Party had nominated a black man who's middle name was Hussein to run for president. They figured beating him would be a cakewalk, and didn't even get too upset when John McCain picked a fringe politician from Alaska as his running mate.

After all, Obama was black and his middle name was Hussein – how could they lose even if their nominee was an elderly crank and their vice presidential nominee was a former sports reporter on local television?

But Obama won and the disrespect began. Congressman Joe Wilson shouted "you lie" during a presidential Joint Address to Congress.

Rumors circulated in the far right blogs that the president was secretly born in Kenya, and therefore wasn't even legitimately President of the United States. He wasn't even a legitimate citizen. After all, he was black.

The question on the minds of so many Republicans was, "What is that black man doing in our White House?"

So they spent the first four years questioning the legitimacy of his even being in office, all the while doing everything they could to prevent him from having any significant successes legislatively.

Then, after he won reelection, their obstruction went into overdrive. And he said,"I have a pen and I'm going to use it."

The argument that this black man was illegitimate had been largely relegated to the fringes by this point, so now a new variation on the argument emerged.

While he may actually have a birth certificate and legitimately be president, his behaviors are illegitimate!

And so, even though this president has issued fewer executive orders then any president since Grover Cleveland, House Speaker and Republican Congressman John Boehner intends to sue him for his illegitimate actions as president.

In John Boehner's memo to his colleagues in Congress he even mentioned how horrified he and his white colleagues were that this black man would dare take such powers. He wrote, "...at times [Obama is] even boasting about his willingness to do it, as if daring the American people to stop him."

It was no coincidence, back in 1980, that the first speech that Ronald Reagan made after he was nominated as the Republican Party's candidate for president, was in a little town of 7,000 people in rural Mississippi. Reagan's opening speech kicking off his presidential campaign, was near Philadelphia, Mississippi – the very town where back in 1964, James Chaney, Andrew Goodman, and Michael Schwerner, were brutally murdered.

And to make sure that all the right-wing white racists got the message, the substance of Reagan's first campaign speech was "States' Rights."

This new attack by John Boehner on President Obama's legitimacy as president of United States is nothing more than an extension of the earlier Republican Birther attack.

Only this time it adds in the very real probability of causing the president much more inconvenience and expense than simply producing a birth certificate. Much like when Bill Clinton was impeached, Obama is now going to be tied up for the last two years of his presidency dealing with courts and lawsuits, and this may go all the way to the Supreme Court.

Not only do Republicans have no shame, but they very definitely know how to speak in "dog whistle language" to the white racists they picked up when they flipped the South Republican after LBJ signed the Voting Rights Act and the Civil Rights Act.

One of the biggest benefits of white privilege is that white people never, ever wonder if something has happened because of the color of their skin (from restaurant tables to jobs to taxis to apartments to just having doors held or not). And so many white people won't immediately "get" what I'm suggesting here, and the largely white right-wing websites will say I've gone over the edge.

But if the callers to my radio show are any indication, most people of color in this country know exactly what Boehner's lawsuit is all about.

In his memo to his Republican colleagues, he talks about the (mostly white Republican) crowds that he visits when he travels around America, and says: "Everywhere I go in America outside of Washington DC, I'm asked: when will the House stand up on behalf of the people to stop the encroachment of executive power under President Obama? The article is in left field. There are legitimate executive overreaches (confirmed by the Supreme Court) that bear witness to a problem that needs correction. The solution should be impeach/convict, but that ain't gonna happen.

I wish people would tell the whole truth. What party tried hard to squelch Civil Rights? Democrats. What paty pushed Clinton to a balanced budget? Republican. Conservatives are not any more racist than Liberals, probably less so. I don't care what color your skin is or where your daddy was born. I want to know, are you honest (leaves out most politicians), and do you have a sense of where this country came from and how we got to be what we are. The US made some boneheaded mistakes and did some terrible things. We also have tried to fix these things. If the US is soooo bad why in the hell do we have millions trying to move here every year?
