A DEA agent commandeered a woman’s identity, created a phony Facebook account in her name, and posted racy photos he found on her seized cell phone. The government said he had the right to do that.

Update: Facebook has removed the page and the Justice Department said it is reviewing the incident.

Could you or I get away with creating a fake online profile using someone else's pictures and pretending to be them while on an online social site?

Sure...some of *us* do, frequently...though I, personally, couldn't and wouldn't.

On another online *dating* site, shortly after joining, I began receiving strange PMs in my private inbox on that site. A little investigating showed that my profile from that site had been lifted, word-for-word and picture-for-picture and placed on a site "One-Night Stands in Stockton". For a monthly fee of $39.95 (billed to a credit card), users could have access to my - and several other women's profiles - complete with email accounts. Once they got the money from the men, they cut the interloping link and suddenly messages - in mid-conversation - began appearing in my inbox.

There were numerous mirror profiles created, used, and run simultaneously alongside the real profiles of people. When those people would complain to the Administrators, nothing would be done...even though it was a violation of the site's own Terms of Service.

People do it all the time; that's one of the reasons Google's 'Reverse Image' feature is so popular. They do it for far less *good* reason than to run a sting operation to find those conducted in illegal activities while online...typically, they do it because the person they're targeting once said something awful and horrific, like


"Sorry...I'm not interested in meeting you."


I'm sure the Government, the FBI, and the Justice Department will get the technicalities and legalities surrounding what can - and can NOT - be done while participating within online communities and will ensure that anyone operating such communities is properly informed of the legalities...and their responsibilities when operating such a site.
