Former top FBI lawyer James Baker, in closed-door testimony to Congress, detailed alleged discussions among senior officials at the Justice Department about invoking the 25th Amendment to remove President Trump from office, claiming he was told Deputy Attorney General Rod Rosenstein said two Trump Cabinet officials were “ready to support” such an effort.

The testimony was delivered last fall to the House Oversight and Judiciary Committees. Fox News has confirmed portions of the transcript. It provides additional insight into discussions that have returned to the spotlight in Washington as fired FBI Deputy Director Andrew McCabe revisits the matter during interviews promoting his forthcoming book.

Baker did not identify the two Cabinet officials. But in his testimony, the lawyer said McCabe and FBI lawyer Lisa Page came to him to relay their conversations with Rosenstein, including discussions of the 25th Amendment.

“I was being told by some combination of Andy McCabe and Lisa Page, that, in a conversation with the Deputy Attorney General, he had stated that he -- this was what was related to me -- that he had at least two members of the president’s Cabinet who were ready to support, I guess you would call it, an action under the 25th Amendment,” Baker told the committees.

The 25th Amendment provides a mechanism for removing a sitting president from office. One way that could happen is if a majority of the president’s Cabinet says the president is incapable of discharging his duties.

Rosenstein, who still works at Justice Department but who is expected to exit in the near future, has denied the claims since they first surfaced in the media last year.

Fox News requested further comment from the parties involved. Lawyers for Baker and McCabe declined comment, as did an FBI spokesperson.

In his testimony, Baker said of McCabe’s state of mind: “At this point in time, Andy was unbelievably focused and unbelievably confident and squared away. I don’t know how to describe it other than I was extremely proud to be around him at that point in time because I thought he was doing an excellent job at maintaining focus and dealing with a very uncertain and difficult situation. So I think he was in a good state of mind at this point in time.”

The testimony, for which they are criminal penalties if the witness lies to congressional investigators, comes as McCabe, who was fired last year by then-Attorney General Jeff Sessions, has discussed the alleged meetings as he promotes his forthcoming book.

As Fox News has previously reported, the eight days in May 2017 between Comey’s firing and appointment of special counsel Robert Mueller were seen as a major turning point in the Russia probe, which has also involved examining whether the president obstructed justice.

“I had the impression that the deputy attorney general had already discussed this with two members in the president’s Cabinet and that they were…onboard with this concept already,” Baker said.

During the closed-door hearing, the former FBI lawyer told lawmakers he could not say whether Rosenstein was taking the initiative to seek out Cabinet members:
Question: “Do you know what direction that went? Was it Mr. Rosenstein seeking out members of the Cabinet looking to pursue this 25th Amendment approach or was it the other way around?”

Baker: “What I recall being said was that the Deputy Attorney General had two members of the Cabinet. So he – how they came to be had, I don’t know, but…”
Question: “So he had two members, almost like he was taking the initiative and getting the members?”

Baker: “That would be speculation on my part.”

Baker also said he did not know the names of the two Cabinet officials.

“Lisa and Andy did not tell me, and my impression was they didn’t know themselves,” he said.

But when the New York Times broke the story in September, it reported that Rosenstein told McCabe he might be able to persuade then-Attorney General Jeff Sessions and then-Secretary of Homeland Security and later White House chief of staff John Kelly to invoke the 25th Amendment.

On Thursday, the top Republicans on the House and Senate Judiciary Committees called for McCabe and Rosenstein to testify before their respective panels, following McCabe's comments about these discussions. Rosenstein did not appear for Capitol Hill testimony to clarify these discussions, despite multiple requests from lawmakers, when Republicans held the majority last year.

Now coming out that certain Clinton loyalists in the FBI were trying to stage a Coup against President Trump. Not only are they in violation of the law as they cant be in negotiations with cabinet members to try to remove a President, there are phone records throughout the campaign on how they will prevent him from becoming President.

This is beyond a simple crime, this is treason

Honestly, I do think this time will be different. Only a few days was Trump's Attorney General FINALLY confirmed.

We are entering into an unprecedented time in America. There will have to be about 40,000 arrests. Obama and Hillary may be able to escape justice for their crimes, but I don't think their underlings are going to fare as well.

We are entering into an unprecedented time in America. There will have to be about 40,000 arrests. Obama and Hillary may be able to escape justice for their crimes, but I don't think their underlings are going to fare as well.


Heh heh... they've got so much on the Obamas and the Clintons that hasn't even been revealed to the public yet. I can see how it would take a battery of attorneys a year or more just to assess all of the charges to determine where to start. Fortunately all it will take is one count of high treason each to have them all executed.

I have a feeling Trump is about to drop some astonishing truth bombs on the American people that will have the general public demanding their executions!

Oh my, I wish I had more time for this! If you have so much on Trump, I'm sure Mr. Mueller would love to hear from you at this point because he's absolutely desperate to find anything he can pin on our legitimately elected president. So far his battery of attorneys and investigators have spent almost two years trying to come up with ANY proof of collusion with Russia and to this day they still have nothing but a fake dossier that Hillary paid for! Just for your information, I'm 13 years down the rabbit hole and one thing I never do is throw out unsubstantiated claims so let's see if you can prove me wrong on what I just told you and while we're at it, page 294 of the inspector General's report last summer indicates that the FBI was fully aware that the clintons and the Clinton Foundation are heavily involved in crimes against children around the world and they failed to do anything about it! Prove me wrong!

According to the FBI's own website they were obviously using a well-known pedophile code language! Prove me wrong! Hillary was caught red-handed taking millions of dollars in bribes from Putin in exchange for 20% of our uranium Supply! They make nuclear weapons out of that stuff ya know so that makes it an act of high treason for directly colluding with the Enemy! Prove me wrong!

Andrew McCabe...the assistant director of the FBI under Mueller admitted it only a few days ago. He said that the FBI and the DOJ were working together to bring Trump down with charges he knew were false.

It's public knowledge now. That genie won't be going back into the bottle and heads are going to roll soon.

the OP states that an FBI employee met with an FBI lawyer and they discussed many things including that there was a party who knew of two other parties considering using the LEGAL 25th amendment where it concerned Trump. There is no quote in the OP of the FBI and DOJ 'working together' with 'false' charges. If such information exists (somewhere besides some secret personal stash of information), I would be open to considering it. Until then, the thread is false based only on what the OP provided.

Empty allegations? Did you not see the proof that I pointed you to? Did you read page 294 of the inspector General's report and do you think I made that up? Have you bothered to read a single one of Hillary or Podesta's emails? Perhaps you never heard the report Ben Swann did about it on TV when the pizzagate Scandal first broke a couple of years ago. (More proof that you're welcome to look up and attempt to dispute any time.) You accuse me of making wild, unsubstantiated allegations And yet when I point you directly to the proof you require, you apparently refuse to even look at it??? Of course this doesn't come as any surprise to me at all given the fact that the Cia's operation Mockingbird has been such a smashing success. In fact if I'm not mistaken, I believe it was William Casey himself, the former head of the CIA who once publicly stated that they would know that their campaign had been a success when everything the American people believe is false! Look it up! It's definitely a piece of documented history and I'm sure that if you look into any of the allegations that I made, you will find that I do not make them lightly and that there is more than enough proof to back them up! Are you by any chance being paid by one of the many Soros organizations to be here and argue with everyone who loves this country and supports our president?
