me and my ex wife well still me wife tech we are just seperated for now but she tole me unless ohio state law requires us to take turns every year she is going to write our daughter off on her taxes every year so i wone be able to. i dont think that is fair because i have my daughter 3 days a week and i pay her 680 a month in child support. what do you guys think

Talk to your attorny and/or accountant.

I don't think you can claim her since your wife has full custody or will have full custody, since you only have her three days.

well it is my understanding that whoever pays over half of the childs support gets to claim them. each state is no doubt different.

Try paying a 1000 a month in child support and she gets to claim them both.

she can tell you whatever she wants but she's not the one that makes that decision........she wants her cake and to eat it too.....see your lawyer in the morning.........I'm wonderin' why you are paying so much child support when you have your child nearly 50% of the time.........she's taking you for a ride........

well actually the state wanted me to pay 200 a month but she went to the courthouse and lowerd it for me some which was nice of her but her daycare is 800 a mnth so i pay 400 of it and the rest is for clothes and food

i get child support...100/week. i have the sole right to claim the children on my taxes, as well.

I dont know if you can stop her from claiming your little girl every year....but in most states you can right off every bit of child support including child care. Just keep ALL of your reciepts. That's usually how it works in Texas anyway. I think you should see a lawyer. Good luck.

just went through all this divorce stuff...the judge set it so he gets to claim one year then i get the next...the kids live with me and he pays...it is up to the lawyer and the judge....just wondering why you are happy that you only have to pay 30ish bucks a week for your child and be happy about it...come on now, i'm sure you eat well during the week...this is your child, gosh!

whats in your divorce papers you should share but the lawyers and judges told us everyother

to be honest if you file first and claim her, you get it
if she makes a stink the tax people will settle it

and i payed child support and i can claim my child we have 50/50 custody but like i said it in the divorce papers

you need to see what you agreed to but if state law says everyother, nail her for tax frad, you do have the legal right stand up and be the "bad" guy.

I don't know about the u.s. but in canada I think it would be dependant on the shared custody agreement and who has the child more than half the time. If it is sole custody, that person can claim.

Then again, it could also mean she could divert some stuff to you like credits for schooling, etc. to offset.

Do you believe that at some point in Canada, and some people are still able to claim a deduction on their tax for the child support they paid? Unbelievable, I say.

If I am not mistaken this is something that will be worked out in your divorce decree .... In most cases it will go to one or the other every other year .

I'm in Ohio that can be decided in the divorce decree, usually what is "fair" is switching off every other year. Or other arangements made to compensate for it.
