While working for a day labor place I fell off a simi trailer while unloading it. I broke my tibia platau bad enough that a surgion had to put a long rod and screws in my leg. which required 42 staples. I just got done spending three months in a convalesent/ rehab place to have help with the recovery and learning how to walk with the walker. I am home now walking with the aid of a walker and a 50% walking boot and brace. Am scheduled for more pyc therapy starting tomorrow for the next month. All along the workers comp company has paid all the rehab and med bills. Plus sending me a paycheck every two weeks. My question is, because of the pain, suffering, anguish that I have had to go through thus far. And will have to go through for the rest of my life, should i start contacting lawyers to try to get a settlement? Any advice would be most welcome.

i have worked with work comp for 13 years. get a lawyer NOW. In my opinion in any work comp, or auto accident you retain a lawyer that day.

That's dicey. People have become too "sue happy" these days, it doesn't matter if the reason is because somebody in Bangladesh farted in somebody else's general direction. If it was your own clutziness that caused the injury, that's all on you. If it was a failure on the part of the company in some way that led to the injury, well then that's a different ballgame. But don't just go suing somebody just for the sake of possibly being able to do it. Too many people already do that.

Even though I also believe that people are too sue happy now days I would suggest that you retain a lawyer. I work in the health field and see people that are dealing with injuries through workman's comp all the time. Whatever you do DO NOT sign anything that closes your case or no matter what you are screwed. Most likely you are going to have problems with your injury for years to come and seeking a good lawyer would be adviseable and to your best interest.

The bone I broke will never be the same again as it once was. Ever. However, I still have to walk on it for the rest of my life. I am not about to sue the contractor of the job site, or the landscapers, or the ladder company, or anybody. I see no point in taking money from somebody when I haven't done anything to deserve it, but sued just because I could. That's just wrong, and it's the reason why insurance premiums are at an all-time high, and paranoia runs rampant.
But then again, I've always been the "odd person" because I "do the right thing". |

Thankyou all for your input. This is the first time in my 54 years of life that I have ever thought of suing anybody. But I know that I am going to have pain and suffering and diffacult walking ( due to the break caused my leg to heal a bit disfigured. And the safety factor I feel was thier neglect due to the fact that the rig and trailer was parked at a slant which caused the big machine which was on wheels to roll towards me causing me to try and move out of the way which resulted in me falling.

Okay, now that's negligence on somebody's part, so somebody is responsible for a certain amount of damage restitution. Basically, it all boils down to common sense. |

I fractured my tibia plateau when I was 25 it still gives me pain. See a lawyer.
