Atheists lose, 'under God' wins in appeals court

Christians are happy and atheists are upset now that it seems U.S. courts are united in saying it's OK to refer to God in the Pledge of Allegiance and on American currency.

On Thursday, the liberal 9th U.S. Circuit Court of Appeals in California weighed in, saying the references to God don't violate any constitutional claims of separation of church and state.

"The Pledge of Allegiance serves to unite our vast nation through the proud recitation of some of the ideals upon which our Republic was founded," Judge Carlos Bea wrote for the court majority.

However, the phrase at the ending of the pledge -- "Under God" -- was added only 56 years ago by Congress.

So it has nothing to do with the founding of the country. If the founders -- while Christian oriented -- would have wanted to put God in any kind of pledge to the new nation, they could have done so.

They didn't.

Thursday's ruling came in a case filed by atheist Michael Newdow, who once had won a lawsuit ruling that the Pledge of Allegiance violated the prohibition against government endorsing a specific religion.

But Thursday's decision is seen as being the last word on the matter, unless the U.S. Supreme Court takes up the case.

Any bet on what the conservative-dominated court would rule if the case makes it that far?

Right, atheists would lose. Again.

I can live with "Under God" on the money, just as long as they keep their beliefs out of the science books, and the law books..

I think it's a safe bet that as long as this trend of Athiest/Non-religious is on the raise, there will be a point when it's asked why "under god" was put there in the first place..

I think it would be harder to get Creationism out of school, and Anti-abortion and Anti-gay rights laws out off the books than to get 'under god' off our money once everyone comes to their senses.

100% agree! Especialy on the last part, why is it so hard for people to embrace individuals, they would sing a different tune if they had to live it XD

But really it is sad how they directly violate church and state in so many ways and wont even own up to it. This country wasnt founded by god. It was people who worked their ***** off and gave their lives etc to unite this nation! where do they get this under god crap!

If the case was about having the name "Jesus Christ" on U.S. currency, of course the religionists would have lost. As is, 'God' is arguably used in the generic sense, and as one of the country's founding principles is freedom of religion, it's a forlorn hope to expunge religion from all the law books. It's already there in indelible ink, and 'Under God' was merely a concession recognizing that fact. Especially in a country that is as overtly religious as the United States is. Small concessions of this type have kept the peace for most of our 200+ years as a nation which did more than any other to push the frontiers of _human_ ability and technological achievement.

I would much rather see the energy that went into this case being used to keep zealotry and religious fundamentalism in check. _THERE_ is where the real danger lies.

I agree, luckily both times (that I'm aware of) that Creationism has tried to legally strong arm it's way into the Science classroom it has failed.

But, there are many, many more important battles ahead..

I thought this was as stupid as when that kid's parents tried to sue the school because they were making them say the Pledge of Allegiance with "under God." Just do what I always did and sit through it, that made my point far clearer than complaining about it.

There is no solution. There will never be any solution. You will never be able to convince enough people to make a meaningful difference that religion is b.s.. It's a fact, stupid people breed faster than smart people. There will always be more of "them" than "us". You would do well to make peace with that reality.

Or you'll end up running naked in the streets screaming incoherently, eventually.

I'm heartened by the fact, though, that even though we have the most conservative Supreme Court in many years, the Religious Right has been steadily losing clout. For all the bluster about bringing back Church over State, they've still not been able to pull that off in the slightest.

In the back of my mind, though, I always think about a sci-fi novel written about 45 years ago: "A Canticle For Leibowitz": where great mobs of people who voluntarily took on the label 'Simpletons' killed anyone who could read.

It's especially chilling when you find out the one of the biggest sellers of the latter decade has been the "Left Behind" series. I find the entire premise of all those novel nauseating, as if the authors would love nothing better than a halocaust to occur just to prove their religious madness as correct.

Dude! Why do you think the world is as f'ed up as it is. Half the people on the planet believe that nothing that happens is of any concern--their godthing will come back soon and fix everything.
Most of the rest are completely comfortable with doing what they can to make it happen, making the world ready for their godthing's return. Even if that involves getting the world as f'ed up as possible.
Either way, we're all totally screwed. yea team. That's why I smoke. I don't particularly want to be around when it all goes to ****. It breaks my heart to see the wonderful potential that is humanity being squandered on stupidity. It really does.

The Law of the Few says that there will always be palace rebellions against Stupid Kingdoms led by a few Young Turks who will destroy the status quo. Look at Stem Cell research-- no less than a sitting president and his henchmen could put a stop to it.

What will probably happen is that just as the West deposed Middle Eastern thought with its own, so will the East come to be the citadel of human technological advancement if the West decides to descend into uber religiousity.

The religionists' Godthing always looks at humans through the jealous eyes of its adherents and finds humans wanting. Sometimes, though, the Unbelievers return the favor with cold, dispassionate logic, displacing those same adherents in favor of a new paradigm.
