Volant,
May I point out one thing. You were most likely "detained" because you were driving without you license ("i didnt have my license on me at the time"). If you are operating a motor vehicle you should have your license on you, I believe it is required in all states. If you do not have a picture ID on you, it is the policemans job to make sure you are who you claim to be.
Please do not harp on your inconvenience for the police officers doing their jobs. YES they do catch other things at DUI checkpoints. It also helps catch people that are wanted on crimes (warrants check) During these checkpoints they can catch wanted felons, and dangerous criminals. They may be a bit inconvenient for John Q. Public. But they are needed across the country due to alot of the popluation having the "Its Ok to have a few drinks and drive" mentality. Impaired driving is impaired driving that includes, medication, Drugs (legal and illegal) and drinking (even one is too many).
So excuse me for standing up for my fellow "brothers in blue". But I deal with on a daily basis (and have for 16 years) the people that they catch during these checkpoints. Next time you drive, I suggest you make sure you have ALL of you paperwork ("yes i had insurance and registration but not my licence (national identity card"). This is part of the responsibility of driving. Do not condemn the deputies for doing the jobs they do that are usually underpaid and highly unappreciated by the general public. They put their lives on the line every day for complete strangers---would you do that?

(Sorry for everyone else for my rant--- HOWEVER this particular post really rubbed me the wrong way)

Deputy Sheriff’s Prayer
When I start my tour of duty God,
wherever crime may be,
As I drive the darkened streets,
let me be close to thee.
Please give me understanding
with both the young and old.
Let me listen with attention
until their story’s told.
Let me never make a judgment
in a rash or callous way.
But let me hold my patience,
let each man have his say.
Lord if some dark and dreary night,
I must give my life,
Lord with your everlasting love
protect those special in my life.

i got stopped as did everybody but also detained for 20 minutes at a dui checkpoint last night

why was i detained at a dui checkpoint for 20 minutes

because my paperwork wasnt in order

is this nazi germany?

i thought this was to keep drunk people from driving

not to search for petty things

why was i asked to show my license , registration and insurance?

i dont drink but still was detained

is this why we have these checkpoints?

or is it getting us ready for marshal law?

they towed a guy in front of mes car and made him walk home on a dark road at 2 am

how is this keeping him /us safe?

dui checkpoints mean dui not papers please

we gave them the name, 'dui checkpoints'. legally they're known as random checkpoints and quite often find far more violations other than those involving dui. yes, random checkpoints does mean 'papers please.' my guess is that the guy who's car was towed had an expired registration or dl or could not show proof of insurance. everything has it's consequences.

i didnt have my license on me at the time

yes i had insurance and registration

but not my licence (national identity card)

that number stays the same all your life much like your ss number

a guy just told me that his daughter 16 couldnt get her license yet

even though she passed the test

because she had to wait for her biometric picture to clear

to prove she wasnt a terrorist or criminal

********************************************

the problem is that they stop everybody and ask for id

so if i was a jew hiding from the nazis i would be caught

the fema cameras even id your passengers not just the drivers

and anyone walking by them

there are tons right by my house

they see you, listen too and smell you

(explained on our local news awhile back)pittsburgh pa

so i guess i should stop going outside or in stores too

im not paranoid

they are there to track the population

not terrorists

the cops cant even see on them

This has nothing to do with nazis or jews. It has to do with you driving without your license and getting caught. And for that reason, you were detained. Why are you making it out to be a bigger deal? You know as well as I do that you're supposed to have your license on you while driving.

Perhaps if you had had a child hit by a driver without a licence or who was Dui you wouldnt be complaining so much.

Honestly the police are their to protect us, let them do their jobs, be polite and helpful to them, think how crappy their day is when they have to deal with people whinging at them all the time..

Honestly whats the big deal, you where pulled over, you didnt have what you should have, how is that their fault..

And if they think that someone is dangerous or is not licenced or may be hiding something, what is the big deal with them checking, it may save your life of someone elses because they did.

And if our countries where safe and people followed the law then the police wouldnt need to search..

Deal with it like a man.

Mon 09/19/11 04:36 AM

so then why not call it search and seizure not dui checkpoint

because they call them 'random checkpoints.' you simply don't get it. a random check point is issued by warrant with specific limitations on what can be searched in order to curtail certain crimes. checking for registration, license, insurance, etc., simply makes sense if a community is also concerned with the dui rate. it costs money to man and set up these checkpoints. i drive without drinking, keep my registration, insurance and dl up to date and i'll be damned if i don't want law enforcement who's salaries i help to pay through taxes to make it tough on somebody who doesn't. so you got burned for not having your paperwork in order. tough do do. get it right next time.

btw, most dui arrests made at these checkpoints would never have happened if the driver had simply kept his mouth shut. a sobriety test is a search and for a search to be legal the officer must have 'probable cause' that a crime has been committed. if he asks if you've been drinking and you answer something like, 'oh, just a beer watching the ball game', you just gave him probable cause. if his next words are, 'please step out of the car', don't be surprised.

(at least in Texas) you don't have to carry ID to walk, etc. But if you get pulled over (suspected in a crime or something) then you do have to prove who you are. Cops can search you by the name you give but it's quicker to show an ID or DL

Variations in “stop and identify” laws

Four states’ laws (Arizona, Indiana, Nevada, and Ohio) explicitly impose an obligation to provide identifying information.
Fifteen states grant police authority to ask questions, with varying wording, but do not explicitly impose an obligation to respond:
In Montana, police “may request” identifying information;
In 13 states (Alabama, Delaware, Illinois, Kansas, Louisiana, Missouri, Nebraska, New Hampshire, New York, North Dakota, Rhode Island, Utah, Wisconsin), police “may demand” identifying information;
In Colorado, police “may require” identifying information of a person.
Identifying information varies, but typically includes
Name, address, and an explanation of the person’s actions;
In some cases it also includes the person’s intended destination, the person’s date of birth (Indiana and Ohio), or written identification if available (Colorado).
Arizona’s law, apparently written specifically to codify the holding in Hiibel, requires a person’s “true full name”.
Nevada’s law, which requires a person to “identify himself or herself”, apparently requires only that the person state his or her name.
In five states (Arkansas, Florida, Georgia, New Hampshire, and Rhode Island), failure to identify oneself is one factor to be considered in a decision to arrest. In all but Rhode Island, the consideration arises in the context of loitering or prowling.
Six states (Arizona, Florida, Indiana, New Mexico, Ohio, and Vermont) explicitly impose a criminal penalty for noncompliance with the obligation to identify oneself.
As of February 2011, the validity of a law requiring that a person detained provide anything more than stating his or her name has not come before the U.S. Supreme Court.

Please don't confuse providing identifying information (which is verbal) to carrying proof of identification (papers).

And, the police still need probable cause to detain you and demand this information. They can ask you to stop and give them information. If you agree it's call a "consensual encounter". If you don't agree they can't force you to stay and answer without probable cause to believe you have been involved in a crime. If they do it's called an illegal detainment.

And stop making it out like the bad guys are the cops. I know more cops that put their lives on the line everyday for crap benefits, a crappy retirement, verbal abuse by the general public when they are caught doing something wrong and lack of common respect for putting their lives on the line.
Now PLEASE.. If you are not willing to take the crap that an officer does. STOP TALKING BAD ABOUT THEM and making it sound like the cops are gonna be the ones doing all this. THAT IS THE GOVERNMENT in general. Cops DO NOT make the laws-- they just have to enforce them.

Now I hope you have a pleasant day.

More people get in accidents that are legit than nonlegit drivers cause why?Theres more legit drivers.Just cause someone is legit doesn't mean they won't cause or get into an accident.
I totally agree with the OP and also i believe the pigs have to much power and there are way to many effin laws/rules.One law is over ridden cause of another law and so the chain reaction begins.
The police aren't protecting the people they are watching over the people.Driving isn't a privledge either it's a state money making scam, along with insurance the biggest scam of them all.

It has always been a law that one must carry a form of ID....

This is just flat out not true.

You need a driver's license to drive. Other than that there is no law stating you must have I.D. I can walk or bike anywhere I want in this country without identification.

Sorry about that I meant to put you need to carry ID in order to drive a vechicle my bad...slaphead

im from pittsburgh pa

cops are mostly good.i have some friends that are cops

but they generate revenue by enforcing laws and protect business from theft

illegal parking, red lights, speeding, fines, fines, fines

law enforcement enforce laws made by politicians to generate money

now im sure this isnt why they joined the force

it was to help and protect the public

it is shown that red light cameras cause more accidents than they prevent

but they generate lots of money

so they stay

i dont hate cops

i hate illegal checkpoints

now lets look at the children who we should keep safe

who drives around in armored cars money not children

im just saying cops need to use morals over laws

and stop using tasers on children and old people

man up and stop being politically correct

most people shouldnt fear cops

unless most people are criminals

yes the government is the true problem

I agree with the OP on this one. Using DUI checkpoints as an excuse to check people for anything besides DUI is making an end run around the 4th Ammendment. The police need probable cause to stop you if you are driving your car. Setting up a checkpoint for drunk drivers and then asking people who are obviously not under the influence for their papers is BS.
